All services provided by Webdesignz by BJ (Webdesignz) are subject to the following terms and conditions. These policies have been put into place to protect both you the client and Webdesignz.

Free Website Mockup

Our website portfolio page clearly show the style of websites we produce. If you wish to obtain a free website mockup, complete our contact form and we will be in contact to discuss your website requirements.

Quotations

On approval of the website mock up we will send you a quote based on your website requirements. All quotes supplied by Webdesignz are valid for one month. If the quote is not accepted by paying a deposit (see “Charges & Fees” below) within one month of the date of the quote then a new quote must be obtained.

Charges & Fees

All new web design projects are split into two payments. An initial 50% deposit will be due on acceptance of quote. The remaining 50% balance will be due upon acceptance of the completed web development project before it is released to the client or published on the internet.

Payments can be made by direct bank deposit (preferred) or cheque.

Website Content

Clients are required to ensure that the content of their website meets all the current Australian legislation regarding publications. The client shall further indemnify Webdesignz in respect of any claims, costs and expenses that may arise from any material included in their site by Webdesignz at the client’s request.

Webdesignz reserves the right not to include any material supplied by the client if Webdesignz deems it inappropriate or offensive.

Unless otherwise specified, all text, images and materials to be incorporated in the website shall be supplied by the client in electronic format, delivered on CD or via email, within fourteen days of acceptance of quote. Content received after this period will incurr extra charges (see website maintenance rates). Proof reading the supplied text is the responsibility of the client.

Website Hosting

The client understands that any website hosting services require a separate contract with a web hosting business. The client agrees to select a web hosting service with allows Webdesignz full access to the website and a cgi-bin, via FTP. The client further understands that the web hostings service's operating system must be on a Unix System/Server. The client may accept the recommendation of Webdesignz for a web hosting service.

Domain Names

The client understands that they must purchase a website domain name from a Domain Name reseller. The client may accept the recommendation of Webdesignz for domain name selection and supplier to purchase their domain name from.

Copyright & Ownership

Webdesignz retains copyright to all completed website design projects produced by Webdesignz. The client will be granted rights to use the web design project as a website, upon final payment of all incurred fees for production of the web design project.

Alterations

Webdesignz will not accept any responsibility for any alterations performed by either the client or a third party which cause errors in the site. Such alterations include, but are not limited to, additions, modifications or deletions. If Webdesignz are required to correct any errors resulting from such alterations, the client will be charged the current website maintenance rate.

Development & Delivery

Webdesignz understands the importance of completing projects in a timely manner. We normally complete all projects within two weeks of receiving the deposit along with complete website content.

Liability

Services purchased from Webdesignz are provided "as is" without warranty of any kind that the web design project will be uninterrupted or error free. In no event shall Webdesignz be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk as to the quality and performance of the web design is with the client.

Acceptance

Please note that by paying your deposit, you are agreeing to all of our terms of service as written here. If you do not agree with any element of our Terms of Service, please do not contact us for a free mock up design, quote or for web design services. Webdesignz reserves the right to change or update these terms at any time without prior notice.
